User Service Agreement

Introduction

Welcome to use Sure products and services. Sure is a constellation app developed by ZODIAC LAND PTE. LTD. Before using Sure platform products and services, you should carefully read and comply with the "Sure User Service Agreement" (referred to as "this Agreement") and other related platform documents such as the "Sure Privacy Protection Policy." Please read and fully understand the terms of each clause, especially the clauses that exempt or limit liability, dispute resolution, and applicable laws. The clauses that exempt or limit liability may be displayed in bold, and you should focus on reading them.

When you fill in the information as prompted on the registration page, read and agree to this agreement, and complete all registration procedures, or you fill in the information as prompted on the activation page, read and agree to this agreement, and complete all activation procedures, or you actually use this platform product and service in other ways allowed by MINDFUL MOOD platform or express or imply acceptance of this agreement in other ways, it means that you have read, understood and signed this agreement, and this agreement will have legal binding force. You promise to accept and comply with the provisions of this agreement. At that time, you should not claim that this agreement is invalid or request to revoke this agreement based on the reasons that you have not read the contents of this agreement or have not received the answers to your inquiries from Sure platform. Unless you have read, fully understood, and accepted all the terms of this agreement, you have no right to use Sure platform products and services.

A. Contracting Parties This agreement is made between the users who use Sure platform services through the Sure platform website, mobile application, PC platform Sure platform application software, hardware and other means, including customers who post information and promote products on the Sure platform (hereinafter referred to as "users" or "you") and ZODIAC LAND PTE. LTD. (hereinafter referred to as "Sure").

B. Content and Effectiveness of the Agreement

The contents of this agreement include the text of this agreement and all the privacy policies, policies, rules, statements, notices, warnings, prompts, and explanations that have been or may be published by the Sure platform (hereinafter referred to as "rules"). The aforementioned rules are an integral part of this agreement and have the same legal effect as this agreement.
The Sure platform has the right to formulate and modify this agreement and relevant rules from time to time as needed. We will announce any changes through the website, and the revised agreement and rules will take effect immediately upon publication and automatically replace the original agreement and rules. If you do not agree to the relevant changes, you have the right to stop using Sure platform products and services. If you continue to use Sure platform products and services or engage in any activities on the website, mobile application or PC platform, it means that you have accepted the revised agreement and rules.

C. Service Content

Sure platform.
Sure platform products and services include the Sure platform official website (https://www.suretalkai.com), the Sure platform open platform, the Sure platform web version, the client, and the services provided by integrating some functions/services of the Sure platform into other third-party intelligent hardware, software, or services and providing them to you ("this service", subject to the specific services provided by the Sure platform). The Sure platform will continuously enrich the terminal, form and other aspects of your use of this service. If you have registered to use one form of service, you can use other services with the same account, and this agreement automatically applies to your use of all versions of software and services.
The services provided by this platform include technical functions such as mood recording, diary recording, and mood reports. These services may be optimized or modified according to changes in user needs or the unilateral judgment of the service provider due to different service versions. All services require internet connection and will consume network traffic during use. Therefore, the traffic fees incurred will be charged by your telecom service provider. Please consult your telecom service provider for specific charging standards.
The Sure platform has the right to decide to change, upgrade, modify, or transfer any part of the service or its related functions and application software, and will announce this on the Sure platform official website (https://www.suretalkai.com).

D. Registration and Account Management

We only collect information necessary to provide the product functionality based on legal, legitimate, and necessary principles.

You acknowledge that when you complete the registration process or use the service in any other way allowed by the Sure platform, you should be a natural person, legal entity, or other organization with full capacity for civil rights and behaviors that correspond to the civil acts you are engaged in. If you do not have the aforementioned qualifications, please do not use the Sure platform services. Otherwise, you and your guardian should bear all consequences resulting from this, and the Sure platform has the right to cancel (permanently freeze) your account. If you are not a user within the Republic of Singapore, you must also comply with the laws of your country or region, and you acknowledge that entering into and performing this agreement does not violate the laws and regulations of the country or region where you belong, reside, or conduct business or other operations.
You may register using your provided or confirmed phone number or other methods allowed by the Sure platform. You should submit true, accurate, complete, and current identification and other relevant information when registering. You understand and agree that the form and content of your registered account name, set avatar, introduction, messages, and other information do not violate laws and regulations (in this agreement, "laws and regulations" refer to the laws, administrative regulations, judicial interpretations, local regulations, local rules and regulations, departmental rules and regulations, and other normative documents currently in effect in the user's place of residence or the country, as well as any amendments and supplements thereto, as well as related policies and regulations, the same below) and public order, good morals, social ethics, and Sure platform rules, and do not infringe on the legal rights and interests of any party. Otherwise, the Sure platform may refuse to register or suspend the service and recover the account and the Sure platform number, and you shall bear the resulting losses.
You understand and agree that the ownership of the registered Sure platform account (including client account and service management account) belongs to the Sure platform. After registration is completed, you only obtain the right to use the account. The right to use the Sure platform account only belongs to the initial applicant for registration and cannot be transferred or provided to others in any way. Otherwise, the Sure platform has the right to immediately revoke the account without notice, and you shall bear the losses caused by the loss of all data, information, and other losses incurred by using this service.
After successful registration, Sure platform will identify and authorize your login based on your identity information. "Identity information" includes but is not limited to your account name and Apple ID. You agree that based on different terminals and your usage habits, Sure platform may adopt different verification measures to identify your identity. Please ensure that you properly safeguard your terminal and account or identity information, and you shall be fully responsible for all activities (including but not limited to clicking agree or submitting various rules and agreements, sharing information or pictures, initiating phone conferences, etc.) carried out using your account and identity information.

You undertake to immediately notify Sure platform in case of unauthorized use of your password or account or any other security issue, and you agree and confirm that, unless otherwise provided by law, Sure platform shall not be liable for any direct or indirect loss or damage arising from the above situations. Unless otherwise provided by law or judicial ruling, and with the consent of Sure platform, your account and password shall not be transferred, gifted, or inherited in any way (excluding property rights and interests related to the account).

You understand and agree that if you do not log in to your Sure platform account for more than 12 consecutive months after registering, Sure platform may cancel the account for the purpose of optimizing management and other reasons.
When you cancel your Sure platform account or stop using the service, Sure platform will handle the account-related content and information in accordance with laws and regulations, and shall not be liable for any responsibility in this regard.
Sure attaches great importance to the safety and protection of personal information of minors. If you are a minor, you must read the Sure service agreement carefully under the supervision of your guardian and obtain your guardian's consent to the agreement. You must use our products or services or provide information to us under the supervision of your guardian and with the "Teen Mode" enabled. If you violate laws and regulations or the content of the Sure service agreement when using Sure products or services, all consequences shall be borne by you and your guardian.

E. Service Usage Rules

You fully understand and agree that the Sure platform only provides you with a service platform, and you should take full responsibility for all actions and results resulting from the use of the service. Accordingly, you should understand that using Sure platform services may involve risks from illegal or improper actions (or information) from others, and you should judge and act on your own, and bear the corresponding risks on your own.
Unless otherwise specified, the services under this Agreement can only be used for non-commercial purposes. You agree not to copy, reproduce, sell, resell or use any part of the Sure platform products and services for advertising or any other commercial purposes.
The management of this platform adheres to the principle of "who publishes is responsible". Anyone who uses this platform to publish or transmit information, or to publish advertising information, lifestyle information, or other promotional information, should comply with relevant laws, regulations, and policies such as the "People's Republic of China Law on Guarding State Secrets", "People's Republic of China National Security Law", "People's Republic of China Cybersecurity Law", "People's Republic of China Advertising Law". You promise not to engage in any illegal or improper activities using the Sure platform products and services, including but not limited to the following behaviors. Otherwise, if any complaints, lawsuits, disputes, or penalties arise from this, you should bear the corresponding legal responsibilities and adverse consequences on your own, and if it causes any losses to Sure (including but not limited to compensation, liquidated damages, fines, lawyer fees, notary fees, litigation fees, expected interest losses, or other direct or indirect losses), you should bear all compensation responsibilities.
You shall not engage in any of the following behaviors, otherwise you shall be liable under Article 5, Paragraph 3 of this Agreement.

4.1 You shall not upload, publish, transmit, or share any information containing any of the following content:

(a) opposing the basic principles established in the Constitution;

(b) endangering national security, divulging state secrets, or subverting state power;

(c) harming the honor and interests of the nation;

(d) inciting ethnic hatred or racial discrimination;

(e) disrupting the state's religious policies, promoting cults and feudal superstitions;

(f) spreading rumors, disturbing social order, and undermining social stability;

(g) disseminating obscene, pornographic, gambling, violent, homicidal, terrorist, or criminal incitement materials;

(h) insulting or defaming others, infringing upon the legitimate rights and interests of others;

(i) containing false, fraudulent, harmful, coercive, infringing upon the privacy of others, harassing, slandering, vulgar, indecent, or other morally offensive content;

(j) containing other content restricted or prohibited by laws, regulations, rules, ordinances, or any other norms with legal effect applicable to Singapore or the country where you are located.

4.2 Impersonating any person or organization, or making false statements or claims in any way related to any person or organization;

4.3 Forging headers or manipulating identification information in any other way to make it appear that the content is being transmitted by the "Sure" platform;

4.4 Disclosing information involving state secrets in any way, such as through publication, discussion, or transmission; publishing, disseminating, or storing documents or information marked with a confidentiality level; publishing or disseminating any text, information, image, or link that violates national laws, regulations, and related policies or infringes on the legitimate rights and interests of third parties.

4.5 Uploading, transmitting, or sharing any content that is known but not authorized to be transmitted based on any law or contract or legal relationship (such as internal information, exclusive, and confidential information obtained or disclosed due to employment relationships and confidentiality agreements);

4.6 Uploading, transmitting, or sharing any content that is suspected of infringing on the rights of others (including but not limited to intellectual property rights such as copyrights, patents, trademarks, trade secrets, etc.);

4.7 Tracking or harassing others in any other way, or sending a large amount of information to friends or other users through this service;

4.8 Uploading, transmitting, or sharing any advertising, promotional information, promotional materials, "junk mail", "chain letters", "direct sales", or any other form of inducement materials, except for the dedicated areas or functions for the aforementioned purposes;

4.9 Engaging in any behavior beyond normal communication and exchange of information among friends or users, internally or externally;

4.10 Adding oneself or inducing others to add oneself to other users as friends (friendship includes but is not limited to one-way friendship and two-way friendship, the same below) for purposes beyond normal communication and exchange of information among friends or users (including but not limited to sending advertisements, spam, harassment or illegal and irregular information).

4.11 Engaging in behaviors that violate the "Six Bottom Lines" requirements, including but not limited to laws and regulations, national interests, citizens' legitimate interests, public order, social morality, and information authenticity.

4.12 Engaging in any behavior that violates Singapore laws, regulations, rules, policies, and normative documents.
You undertake not to engage in the following behaviors with regard to this software and service, otherwise you will be liable in accordance with Article 5.3 of this Agreement:

5.1 Uploading, posting, emailing or otherwise transmitting materials containing computer viruses or other computer code, files and programs that interfere with, disrupt or limit the functionality of any computer software, hardware or communication equipment related to this service;

5.2 Interfering with or disrupting the servers and networks connected to this service, or violating any regulations, procedures, policies or norms related to the connection network of this service;

5.3 Modifying or forging instructions or data in the software during operation, adding, deleting, changing the functionality or performance of the software, or operating or disseminating software or methods for the above purposes, whether or not for commercial purposes;

5.4 Logging in or using the Sure platform software and services through third-party software, plugins, cheats, systems or other unauthorized means, or creating, publishing, transmitting non-Sure platform developed or authorized third-party software, plugins, cheats, systems, etc., for logging in or using Sure platform software and services;

5.5 Interfering with the software and its components, modules, data, etc. by yourself, authorizing others, or using third-party software.
You undertake to strictly comply with this Agreement when using Sure platform services, otherwise you will be liable in accordance with Article 5, Paragraph 3 of this Agreement.

You agree and accept that Sure platform does not need to monitor in real-time the information and data you upload, transmit or share, but Sure platform has the right to review, monitor and take corresponding actions on your use of the service, including but not limited to deleting information, suspending or terminating the service, and reporting to relevant authorities.

You undertake not to use the Sure platform products and services in any form that infringes on the interests of Sure platform, or engage in any behavior that may cause harm or be detrimental to Sure platform, otherwise you will be liable in accordance with Article 5, Paragraph 3 of this Agreement.

You understand and agree that during the provision of services by Sure platform, Sure platform may send you learning tasks or promotional information.

You fully understand and agree that you are responsible for all activities under your registered account, including any content you post and any consequences arising therefrom. You should judge the content you encounter when using the service yourself, and bear all risks arising from the use of the content, including the risk of relying on the accuracy, completeness, or usefulness of the content. Sure platform cannot and will not be liable for any losses or damages caused by the aforementioned risks.

If Sure platform discovers or receives reports from others that you have violated the provisions of this Agreement, Sure platform has the right to delete or block the relevant content at any time without notice, and take measures including but not limited to canceling your account, restricting, suspending, or terminating your use of part or all of the Sure platform products and services, and pursuing legal responsibilities.

F. Third-party applications and services

Sure platform allows third-party applications to access the platform's services. You can directly access third-party application services such as calculation software on the Sure platform. You understand and agree that Sure platform is only a platform provider, and the relevant applications are independently provided by the third party. Except as otherwise provided by laws, regulations, and this agreement, Sure platform shall not be responsible for your use of the application.
You understand and agree that if Sure platform makes adjustments, suspends or terminates part or all of its products and services, which affects the third-party application services, Sure platform shall not be responsible for any such impact.
When you use Sure platform through third-party applications or services, Sure platform may call third-party systems or support your use or access through third parties, and the results of use or access are provided by the third party.
You understand and agree that when using third-party applications and services in Sure platform services, you should also comply with the third-party user agreement in addition to complying with the provisions of this agreement.

G. Suspension or Termination of Services

Given the special nature of internet services, Sure platform has the right to modify the service content, and may also interrupt, suspend, or terminate all or part of the service at any time.
You understand and agree that Sure platform may periodically or irregularly maintain or repair the platform equipment, facilities, and software and hardware that provide network services. If the charging service is suspended for a reasonable period of time due to such circumstances, Sure platform shall not be responsible.
If any of the following default situations exist, Sure platform may immediately suspend or terminate the service to the user, and request the user to compensate for the losses, including but not limited to compensation, liquidated damages, fines, lawyer fees, notary fees, litigation costs, expected loss of benefits, or other direct or indirect losses:

3.1 User violates the registration obligation in Article 4;

3.2 User fails to pay the corresponding service fee according to the regulations when using the charged network service;

3.3 User violates the provisions of Article 5 on service usage regulations.

H. Privacy Protection

The account you registered on the Sure platform service has password protection function to ensure the security of your basic information. Please keep your account and password information safe.
Sure platform strives to adopt various reasonable physical, electronic and management security measures to protect your information, so that the information and communication content stored in the Sure platform will not be leaked, damaged or lost, including but not limited to SSL, information encryption storage, and data center access control. We also implement strict management on employees or outsourced personnel who may access the information, including but not limited to different permission controls according to their positions, signing confidentiality agreements with them, and monitoring their operations. Sure platform will provide corresponding security measures according to the existing technology to protect your information and provide reasonable security guarantees. We will do our best to prevent your information from being leaked, damaged or lost at any time, but please also be aware that there is no absolute perfect security measure on the information network. Please keep relevant information safe.
You should keep your terminal, account and password, and relevant information and content safe. You shall be solely responsible for the data loss or theft caused by your own reasons, as well as the deletion or storage failure of relevant data in the platform software and services.

I. Intellectual Property Rights

You understand and agree that unless otherwise stated by Sure platform, all intellectual property rights (including but not limited to copyrights, trademarks, patents, trade secrets, etc.) and related rights of all products, technologies, software, programs, data, and other information (including but not limited to text, images, pictures, photos, audio, video, graphics, colors, page design, electronic documents) included in the services under this Agreement are owned by the "Sure" platform or its affiliated companies.
You shall ensure that, without obtaining written authorization from Sure platform, you shall not (and shall not allow any third party to) exercise any of the aforementioned rights, including but not limited to rental, lending, sale, dissemination, copying, modification, reproduction, compilation, publication, printing, reverse engineering, reverse assembling, or any other acts of discovering the source code, etc.
The logos, Sure platform text, graphics and compositions, as well as other trademarks, logos, product and service names of Sure platform involved in its products and services are all trademarks or copyrights of Sure platform in Singapore and other countries. Users may not display, use, or handle them in any way without written authorization from Sure platform, nor may they indicate to others that they have the right to display, use or handle them.
You understand and agree to authorize Sure platform to use your name, trademark, and logo for promotion and advertising purposes, but only to indicate that you are our customer or partner.

J. Platform Liability

The services will be provided "as is" and "as available" without any express or implied warranties, including but not limited to the warranties of applicability, absence of errors or omissions, continuity, accuracy, reliability, suitability for a particular purpose, or any other warranties, declarations, or promises.
Sure platform makes no promises or guarantees regarding the effectiveness, accuracy, correctness, reliability, quality, stability, completeness, or timeliness of the technologies and information involved in the services.
Under no circumstances shall Sure platform be held responsible for any unavailability or delay in the services caused by force majeure or other reasons.
Regardless of foreseeability or the form of action, Sure platform shall not be liable for any special, direct, indirect, punitive, incidental, or consequential damages or any other damages (including but not limited to loss of profits or interests, business interruption, and data loss) caused by the following reasons:

4.1 Use or inability to use specific services;

4.2 Expenses incurred by purchasing or acquiring any products, samples, data, information, or engaging in transactions or other activities that can replace the aforementioned activities through the services;

4.3 Unauthorized access or modification of data or data transmission;

4.4 Statements or actions made by third parties through the services;

4.5 Other damages related to the services, including negligence.
During the use of Sure platform, if a user is unable to successfully obtain the corresponding paid report due to platform bugs, vulnerabilities, server failures and other issues, Sure platform is responsible for re-drafting the user's paid content and providing it to the user.
You understand and agree that in the process of using the service, there may be risks of receiving threatening, defamatory, offensive, or illegal content or behavior, or infringement of the rights of others (including intellectual property) and anonymous or false information from any other person. Based on the Service Use Specification, you shall assume such risks on your own and Sure platform shall not be liable for any of them.

K. Breach of Contract Liability and Compensation

If Sure platform finds or receives a report from others that you have violated the provisions of this agreement, Sure platform has the right to delete, block, and take measures including but not limited to limiting, suspending, or terminating your use of Sure platform account and services, restricting, suspending, or terminating your use of part or all of the service, and pursuing legal liability without prior notice. The losses include but are not limited to compensation, liquidated damages, fines, lawyer fees, notary fees, litigation costs, expected interest losses or other direct or indirect losses.
You agree that if any third party makes any claim or request against Sure platform, or Sure platform incurs any loss due to your information uploaded, transmitted, or shared through the service, your use of other functions of this service, your violation of this agreement, or your infringement of any third party's rights, you agree to fully compensate Sure platform for losses including but not limited to compensation, liquidated damages, fines, lawyer fees, notary fees, litigation costs, expected interest losses or other direct or indirect losses.

L. Effective Notice

Any notice sent by Sure platform to you can be delivered through email, page public announcement area, personal network area prompts, mobile phone messages, or regular mail, and such notice shall be deemed as delivered and effective from the date of sending.
You agree that any notice sent by you to Sure platform should be sent to the online or offline contact information, communication address, email, or other contact information that Sure platform has officially announced or informed you of in the manner described in Article 15, or by using other notice methods recognized by Sure platform.

M. Dispute Resolution and Other Provisions

The interpretation, application, amendment, and any disputes arising from or in connection with this Agreement shall be governed by the laws of the Republic of Singapore, and shall be subject to the jurisdiction of the courts of the domicile of the contracting party of Sure, which is Beijing Sure Culture Media Co., Ltd.
If any provision of this Agreement is deemed invalid or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.
Sure's waiver of any right under this Agreement in the event of your fault or breach shall not be deemed a waiver of any other or similar fault or breach in the future.
This Agreement supersedes all prior oral and written agreements, arrangements, understandings, and communications or notices between the parties with respect to any matters relating to this Agreement.
